How to get a death certificate in Rhode Island

Certified copies in Rhode Island come from Rhode Island Department of Health, Center for Vital Records, and city/town clerks.

From the state office, the first certified copy of a death certificate costs $22 in person or $25 by mail, and each additional copy of the same record ordered at the same time costs $18. Expedited service costs an extra $7.

For deaths from 2022 onward, any Rhode Island city or town clerk can issue a copy. For earlier deaths, go to the clerk in the city or town where the death occurred or where the person lived.

Order more copies than you think you need. Banks, life insurers, pension plans, brokerages and the DMV often want an original certified copy, while Social Security can usually be notified by the funeral home. Five to ten copies is common; our guide on how many death certificates you need walks through the list.

Rhode Island small estate procedure: Voluntary informal administration of small estates (Probate Court)

Rhode Island's small estate procedure applies when the estate is made up only of personal property (not counting tangible personal property) worth $15,000 or less. It cannot be used for real estate.

File a petition with the probate court of the city or town where the person lived, at least 30 days after the death and only if no other probate petition is pending. Use form PC-1.9 if there was a will or PC-1.10 if there was not, and attach a death certificate and a list of assets.

Rhode Island probate courts are run by each city or town, so ask the local probate clerk for the current filing fees.

What counts toward the limit

The small estate limit in Rhode Island is measured against the probate estate, not everything the person owned. Accounts with a named beneficiary (life insurance, 401(k)s, IRAs), payable-on-death bank accounts, joint accounts with right of survivorship, and trust assets generally pass directly and are left out of the count. Step by step in Rhode Island

  1. Get several certified copies of the death certificate first; nothing else moves without them.
  2. Make an inventory: bank accounts, vehicles, investments, real estate, and anything with a named beneficiary.
  3. Separate out non-probate assets, then total what is left and compare it with the Rhode Island threshold.
  4. Wait out any required waiting period and complete the Voluntary informal administration of small estates (Probate Court).
  5. Collect the assets, pay legitimate debts and final bills, and distribute the rest to the people entitled to it, keeping a written record.

When the small estate route doesn't fit

If the estate is over the limit, includes property the Rhode Island procedure cannot transfer, or the family disagrees about who gets what, plan on regular probate. The same applies when there is a business, significant debt or a disputed will. Many probate courts run free self-help centers, and a short consultation with a Rhode Island estate attorney can save expensive mistakes. The executor checklist lays out what a full probate involves.
